1. General Policy

Awesome Academy is committed to maintaining a fair and transparent refund policy in accordance with applicable Malaysian laws, including the Consumer Protection Act 1999 (Act 599).

All payments made to Awesome Academy are subject to the terms and conditions of this Refund Policy.

Fees paid for services already provided, goods supplied or used, and applicable cancellation charges may be retained by Awesome Academy to the extent permitted by law.

Where a student’s enrollment constitutes a future services contract under Section 17 of the Consumer Protection Act 1999, the student’s statutory cancellation and refund rights shall apply.

2. Fees and Refund Eligibility

The following payments are subject to the applicable terms of this policy:

· Registration fees

· Tuition fees

· Visa processing fees

· Administrative fees

· Accommodation arrangements

· Study materials and other enrollment-related fees

Fees relating to services already delivered, goods used or retained by the student, and applicable cancellation charges may be deducted from any refund, subject to applicable law.

For future services contracts governed by Section 17, Awesome Academy may charge:

1. A cancellation fee of 5% of the full contract price.
2. The cost of goods used or retained by the student.
3. The proportion of the contract price representing services already received by the student.

Any remaining amount paid in excess of the applicable charges shall be refunded in accordance with statutory requirements.

No provision in this policy shall exclude or restrict a student’s rights under applicable Malaysian consumer protection laws.

3. Circumstances Where a Refund May Be Granted

Refund requests may be considered under the following circumstances:

· Duplicate or accidental payments.

· Overpayments resulting from administrative or technical errors.

· Withdrawal or cancellation before the course commencement date.

· Withdrawal or cancellation after the course has commenced.

· Any circumstances in which a refund is required under applicable Malaysian law.

· Other exceptional circumstances approved by Awesome Academy’s Management.

Refund eligibility and the amount payable shall be assessed based on the services already provided, goods supplied, applicable cancellation charges, and the student’s statutory rights.

Requests involving personal circumstances, change of mind, non-attendance, or visa refusal shall be assessed in accordance with this policy and applicable law.

4. Withdrawal Before Course Start

Students who decide to withdraw or cancel their enrollment before the course commencement date may submit a cancellation request to Awesome Academy.

Where Section 17 of the Consumer Protection Act 1999 applies, Awesome Academy may deduct the applicable cancellation fee of 5% of the full contract price, together with any permitted charges for goods supplied or services already received.

The remaining refundable balance shall be returned to the student in accordance with applicable law.

Where Section 17 does not apply, refunds shall be assessed in accordance with the applicable contractual terms and Malaysian law.

5. Withdrawal After Course Start

Students who decide to withdraw after the course has commenced may request cancellation of their enrollment.

Where Section 17 applies, Awesome Academy may deduct:

· The applicable cancellation fee of 5% of the full contract price.

· The value of classes or educational services already received by the student.

· The cost of study materials or other goods used or retained by the student.

The value of educational services received shall be determined by reference to the contracted course price and the portion of the course already delivered to the student, using a reasonable and transparent calculation.

Any remaining refundable balance shall be returned in accordance with applicable law.

Failure to attend scheduled classes does not automatically constitute cancellation. Students are encouraged to notify Awesome Academy promptly when they wish to withdraw.

6. Visa Applications

Awesome Academy may assist international students with visa applications. However, visa approval remains solely at the discretion of the relevant Malaysian immigration authorities.

Visa-related charges may include:

· Government and immigration processing fees.

· Education Malaysia Global Services (EMGS) fees, where applicable.

· Medical insurance and medical screening fees.

· Administrative and documentation services.

· Other third-party charges associated with the visa application.

Where visa applications have already been submitted or relevant services have been performed, applicable fees for services already received and goods supplied may be deducted or retained to the extent permitted by law.

Any refund relating to visa services shall take into account the applicable contractual arrangements, third-party refund rules, and statutory consumer rights.

Visa refusal, delay, cancellation, or withdrawal does not automatically entitle a student to a full refund or automatically extinguish the student’s legal refund rights.

Tuition fees associated with an uncommenced or partially completed course shall be assessed separately in accordance with Sections 4 and 5 of this policy and applicable law.

7. Refund Method

Where a refund is due, Awesome Academy will ordinarily return the refundable amount through the original payment method used by the student whenever reasonably possible.

If the original payment method is unavailable, the academy may arrange a suitable alternative refund method, subject to reasonable identity and payment verification requirements.

Students may be requested to provide relevant payment records, identification details, and bank account information where necessary to facilitate the refund.

Such administrative requirements shall not be used to unreasonably delay or restrict refunds required by law.

8. Refund Processing Time

For cancellations governed by Section 17 of the Consumer Protection Act 1999, any refundable balance shall be refunded or made available to the student within 14 calendar days from the effective date of cancellation, in accordance with statutory requirements.

For other approved refunds not subject to this statutory timeframe, Awesome Academy will aim to process the refund within 14 to 30 business days, subject to applicable law.

Processing times for the receipt of funds may also depend on the student’s bank, payment provider, or financial institution.

Awesome Academy shall not impose administrative procedures or processing requirements that override any mandatory statutory refund deadline.

9. Policy Acceptance

By making payment and enrolling in a program offered by Awesome Academy, the student acknowledges that they have been provided with this Refund Policy and agree to its terms and conditions, subject to applicable Malaysian law.

Acceptance of this policy does not constitute a waiver, exclusion, or restriction of any statutory consumer rights.

In the event of any inconsistency between this Refund Policy and the applicable provisions of the Consumer Protection Act 1999 or other mandatory Malaysian laws, the applicable statutory provisions shall prevail.

Awesome Academy reserves the right to update this policy from time to time to reflect operational requirements and changes in applicable laws, without retrospectively diminishing students’ accrued statutory rights.
